Terms of Use

Acceptance & Eligibility

You confirm you are at least 13 years old. If you are under 18, you represent that you have parental or guardian consent to use the App.

Children's Privacy (COPPA / GDPR): The App is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you are in the EEA or UK, you must be 16 or older (or have verifiable parental consent) to use the App.

Your use must comply with all applicable laws and regulations. You also agree to our Privacy Policy.

Changes to These Terms

We may update these Terms from time to time. For material changes, we will notify you via in-app notice and/or email. Your continued use of the App after changes become effective means you accept the updated Terms.

Accounts & Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at support@furfolioapp.com of any unauthorized use or security breach.

App Features & Permitted Use

FurFolio is an all-in-one pet care platform. The App currently includes, but is not limited to, the following features:

You may use the App solely for lawful, personal, non-commercial purposes in accordance with these Terms. You may not access the App through automated means (bots, scrapers) or use it to build a competing product.

User Responsibilities

You agree you will not:

• Post false, misleading, offensive, or illegal content.
• Harass, threaten, or abuse other users; send spam or scams.
• Attempt to exploit, reverse-engineer, hack, or damage the App or its services.
• Submit false missing pet reports or abuse the QR tag / scan system.
• Upload documents or files that contain malware or violate third-party rights.
• Share or misuse another person's pet or account data without authorization.

We may suspend or terminate accounts that violate these Terms.

Zero Tolerance for Objectionable Content

Strictly prohibited in the App (including pet profiles, forum posts, messages, and any other user-submitted content):

• Hate speech, threats, or harassment.
• Violent, obscene, or sexually explicit content.
• Misinformation, impersonation, or illegal activity.
• Spam, scams, or self-harm promotion.
• Animal abuse, cruelty, or content that glorifies harm to animals.

Consequences may include content removal, account suspension or permanent ban, and, where appropriate, legal action. You can report content using the Report button in the App.

Moderation, Reporting & Appeals

We may monitor, remove, restrict, or moderate content that violates our policies. Users can report content using the in-app Report feature. Repeated violations may result in a permanent ban.

You may appeal content removals or account actions by contacting support@furfolioapp.com. We will review appeals and respond within a reasonable time.

User-Generated Content & License

You retain ownership of content you post (including pet photos, forum posts, profile information, and uploaded documents).

You grant FurFolio a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, display, and distribute your content solely to operate and improve the App. We will not sell your content to third parties.

We may remove or disable access to content that violates these Terms. FurFolio is not liable for user-generated content.

DMCA / IP Claims: If you believe content infringes your rights, email support@furfolioapp.com with: your contact information, a description of the work, the allegedly infringing content's location, a statement under penalty of perjury that the use is unauthorized, and your signature.

QR Tags, Scan Data & Pet Safety

FurFolio QR smart tags link to your pet's public profile. When someone scans your tag, we record anonymized scan analytics (time, approximate location, and an optional scan reason such as "Safe With Me," "Possible Lost," or "Viewing Info"). This data is accessible only to the pet's owner and is used to help you monitor your pet's safety.

You may mark a pet as Missing to enable community-wide missing pet alerts. By doing so, you agree that limited pet profile information will be displayed to other users to aid in recovery.

You are responsible for ensuring the accuracy of your pet's profile information. FurFolio is not responsible for outcomes arising from incorrect or incomplete pet information displayed on a public profile.

You may customize your tag's public visibility and the information shown on your pet's public profile at any time through the Tag Management settings in the App.

Trusted Access (Co-Owners & Sitters)

You may grant other FurFolio users access to your pet's profile as a co-owner or sitter. Trusted users may view or update pet information according to the permission level you assign.

You are responsible for the accuracy of information entered by trusted users. You may revoke trusted access at any time from your pet's settings. FurFolio is not liable for actions taken by trusted users you have authorized.

Blocking & Privacy Protection

You can block other users to prevent them from viewing or interacting with your profile. Blocked users cannot see your content or contact you through the App.

Abusing the blocking or reporting features (e.g., to harass or silence legitimate users) may result in account review or suspension.

Subscriptions, Billing & Cancellations

FurFolio offers free and paid subscription tiers. Paid features and per-tier limits are described in the App and may change over time.

• Billing: Handled by the Apple App Store or Google Play. FurFolio does not store your full payment details.
• Auto-Renewal: Subscriptions auto-renew unless canceled at least 24 hours before the end of the current billing period.
• Manage or Cancel: Use your device's App Store or Google Play subscription settings.
• Free Trials: Free trials automatically convert to a paid subscription unless canceled before the trial ends.
• Refunds: Subject to the App Store or Google Play refund policies. Requests must be made through the respective store.
• Tier Changes: Access to features may change if you upgrade, downgrade, or cancel your subscription.

Health & Safety Disclaimer (AI Vet & Content)

The AI vet assistant, health tracker suggestions, forum posts, tips, and any content in the App are provided for informational purposes only and do not constitute veterinary or medical advice.

Always consult a licensed veterinarian for diagnosis, treatment, or medical decisions for your pet. In an emergency, contact your local emergency veterinary clinic or call 911 (or your local emergency number) immediately.

FurFolio does not practice veterinary medicine and does not provide veterinary services. We are not responsible for any harm arising from reliance on AI-generated or user-posted health information.

Third-Party Services & Affiliate Links

The App may integrate with or link to third-party services (e.g., Google Maps for location features, Amazon for product recommendations). We may earn a commission if you purchase through affiliate links at no additional cost to you.

We do not allow third-party advertising trackers. Data shared with integrations is limited to what is necessary to provide the specific feature. Use of third-party services is at your own risk and subject to their respective terms and privacy policies.

Intellectual Property

The App, including its software, text, graphics, logos, trademarks (including "FurFolio"), icons, and other materials, are the intellectual property of Broadview Enterprises LLC or its licensors. All rights reserved.

You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works from any part of the App or its content without prior written permission from Broadview Enterprises LLC.

App Store Terms

Your download and use of the App via the Apple App Store or Google Play Store are also subject to those platforms' terms and policies. Where there is a conflict between those terms and these Terms, the platform terms may apply with respect to platform-specific matters.

Apple Inc. and Google LLC are not parties to these Terms and have no obligation to provide support or maintenance for the App.

Privacy & Your Rights

We process personal data in accordance with our Privacy Policy. FurFolio is designed to minimize data collection — we only collect what is needed for the App to function.

Depending on your location, you may have rights to access, correct, export, or delete your personal data. To exercise your rights or request a data deletion or export, contact support@furfolioapp.com. You may also delete your account and associated data directly from within the App.

Communications

By using the App, you consent to receive essential service-related communications, such as account updates, subscription notices, missing pet alert notifications, and scan activity alerts. You can manage push notification preferences and email notification settings in the App's Settings screen.

Warranty Disclaimer

The App is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted, error-free, or secure operation of the App.

Limitation of Liability

To the maximum extent permitted by applicable law, FurFolio and its affiliates, officers, employees, agents, and licensors are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, goodwill, or other intangible losses, arising from:

• Your use of or inability to use the App;
• Any content posted or transmitted through the App;
• Unauthorized access to or alteration of your data;
• Outcomes related to missing pet alerts, QR scans, or AI vet suggestions.

Our total cumulative liability to you shall not exceed the amount you paid for the App or subscription in the 12 months immediately preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless FurFolio, Broadview Enterprises LLC, and their affiliates, officers, employees, and agents from and against any claims, liabilities, damages, judgments, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the App; (b) your content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

Governing Law & Dispute Resolution (U.S.)

These Terms are governed by and construed in accordance with the laws of the State of North Carolina, USA, without regard to its conflict-of-law rules.

Arbitration & Class-Action Waiver: Except for matters that may be brought in small-claims court, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. You and FurFolio each waive the right to a jury trial and to participate in a class action or class-wide arbitration.

Opt-Out: You may opt out of the arbitration agreement by sending written notice to support@furfolioapp.com within 30 days of first accepting these Terms. Your notice must state your name and that you are opting out of arbitration.

Termination

You may delete your account at any time from within the App. Deleting your account will remove your personal data in accordance with our Privacy Policy.

We may suspend or terminate your access to the App at our discretion for violations of these Terms, illegal activity, or as required by law. Upon termination, the license granted to you ends immediately and you must cease all use of the App.

Miscellaneous

• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect.
• No Waiver: Our failure to enforce any provision of these Terms is not a waiver of our right to do so in the future.
• Assignment: You may not assign or transfer your rights under these Terms. We may assign our rights and obligations without restriction.
• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and FurFolio regarding your use of the App and supersede all prior agreements.
• Language: These Terms are written in English. In the event of any conflict between a translated version and the English version, the English version prevails.
